The present general conditions of sale apply to all orders placed on the pulpedevie.com website
The company ORGANIC PROVENCE S.A.S reserves the possibility of adapting or modifying at any time the present general conditions of sale. In case of modification, the general sales conditions in force on the day of the order will be applied to each order.
1. General conditions: acceptance and application
The buyer acknowledges having read the General Terms and Conditions of Sale clearly stated by the company ORGANIC PROVENCE S.A.S for its website pulpedevie.com and accepts them without reserve at the time of placing the order. These general terms and conditions of sale will prevail over any other condition appearing in any other document, except prior, express and written derogation. The seller is defined below as the company ORGANIC PROVENCE S.A.S via pulpedevie.com, whose head office is located at 58 La Canebière, 13001 Marseille, FRANCE. Telephone : 09 72 53 51 75.
The company ORGANIC PROVENCE S.A.S is registered in the Trade and Companies Register of Marseille under the number of Siren 519 105 029 and the buyer is defined below as the company or the person signing and accepting the present conditions of sale. The buyer declares to have the capacity to contract the sale under the conditions described below, that is to say to have the legal majority and not to be under guardianship or curatorship.
Any order of a product proposed on the site supposes the consultation and the express acceptance of the present General Conditions of Sale, without however that this acceptance is conditioned by a handwritten signature on behalf of the user. In accordance with the provisions of articles 1316 to 1316-4 of the Civil Code, completed by the Decree n° 2001-272 of March 30, 2001, taken for the application of article 1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation of the order form such as specified in article 2, constitutes an electronic signature which has, between the parts, the same value as a handwritten signature.
The automatic recording systems communicated by internet are considered as proof of the nature, content and date of the order. In case of order by Internet, the company ORGANIC PROVENCE S.A.S confirms the acceptance of its order to the customer at the email address indicated by the customer.
After having taken note of the status of his order, and once all the information requested has been completed by the buyer, the latter will be able to validate his order to pay for it. He will choose the means of payment he wishes to use to pay his order, it being understood that the buyer must have this means of payment.
The sale will be considered as final only after the sending to the purchaser of the confirmation of the order by the company ORGANIC PROVENCE S.AS via pulpedevie.com and cashing by this one of the entirety of the price. The company ORGANIC PROVENCE S.A.S recommends that the buyer keep this information on a paper or computer document. The company ORGANIC PROVENCE S.A.S reserves the right to cancel any order of a customer with whom would exist a litigation relating to the payment of a completely or partially unpaid previous order.
On our electronic catalog pulpedevie.com, prices are always indicated in Euros, all taxes included (V.A.T.), only the shipping costs remain at the buyer's charge if the amount of his invoice does not reach the amount entitling him to free shipping costs.
The company ORGANIC PROVENCE S.A.S reserves the right to modify its prices and services at any time, the products invoiced will be the prices announced on the electronic tariff of pulpedevie.com in force at the time of the recording of the orders. The products remain the property of ORGANIC PROVENCE S.A.S. until the complete payment of their price. The prices are expressed in Euros. The transactions are always carried out in Euros. The price indicated on the product sheet does not include the price of transport. The price indicated in the order confirmation is the final price. Moreover, it includes VAT, shipping and packaging costs.
4. Availability of ordered products
In case of temporary unavailability, ORGANIC PROVENCE SAS will warn by email the buyer who will have one week to ask for the cancellation or the exchange of his order by contacting our customer service via this form: https://www.pulpedevie.com/contact. The company ORGANIC PROVENCE SAS reserves an additional week for the processing of the order. If a product is definitively unavailable after the order is placed, the buyer will be informed in the same way by e-mail or by telephone of the items that are definitively out of stock. If no request from the buyer was noted after this period, the order will then be sent with the available items and only these items will be charged.
The products are offered within the limits of available stocks. In case of unavailability of one of the products, the buyer will be informed when consulting the product on the website. This information may be notified to him/her, as far as possible, in the following manner: when the order is placed; following the validation of the order, prior to delivery, by e-mail. The company ORGANIC PROVENCE SAS will then make the necessary arrangements with the Payplug payment interface to subtract the price(s) of the unavailable product(s) from the amount deducted from the buyer's bank account, if the payment was made by credit card, or with Paypal, if applicable. In case of payment by check, ORGANIC PROVENCE SAS will reimburse by check the overpayment.
ORGANIC PROVENCE SAS will deliver to the address indicated on the order. If the buyer indicates an incorrect or incomplete address, he/she will be held responsible for the impossibility of delivering the order. If your parcel returns to us because of an erroneous or incomplete address, the forwarding charges will be at your charge whatever the amount of your order according to the tariff in force of your country code.
Any delay in delivery does not entitle the buyer to claim damages. The buyer must check the good condition of the parcel upon reception of the delivery and if necessary, must express reservations to the deliverer or refuse the delivery. The following are considered as cases of force majeure discharging the company ORGANIC PROVENCE SAS from its obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being delivered.
The products travel at the risk of the recipient. Always check your package upon arrival. If you have the slightest doubt upon receipt of the package on the condition of the said package, it is up to you to refuse it, otherwise the company ORGANIC PROVENCE S.A.S will not be able to refund your package.
The leadtime between the placement of the order by the customer and the delivery of the goods depends on the method of payment chosen by the customer.
For reasons of order preparation and availability of products (out of stock, stop of production etc.), an order can be delivered in several times to the customer who will pay only once the delivery charges.
As an indication, our service provider La Poste delivers in all of metropolitan France within 48 hours. Any possible overrun will not give rise to damages, withholding or cancellation of the order by the buyer.
In any case, and in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum of thirty days from the day after the buyer has registered his order, subject to full payment of the price.
In the absence of delivery at the end of this period, the buyer will have the possibility of cancelling his order. The sums paid by the buyer will then be returned to him without delay, excluding any other compensation. In the event of a delay in delivery in relation to the date initially set, the buyer must report it in writing (letter, e-mail) to ORGANIC PROVENCE S.A.S in order to improve the quality of service that can be offered and to allow ORGANIC PROVENCE S.A.S to conduct an investigation with the carrier.
The delivery times depend on the delivery address communicated by the buyer. The company ORGANIC PROVENCE S.A.S will not cover the customs duties related to the orders delivered outside the European Union. The transport costs displayed at the time of the recording of the orders do not take into account possible customs duties which can be invoiced at the time of the delivery.
Free shipping is only available for orders to Metropolitan France for an amount equal to or higher than 50€ including VAT.
6. Delivery issue due to the carrier
Any anomaly concerning the delivery (missing product and appearing on the invoice, damaged package, broken products, damage ...) must be imperatively indicated on the delivery order in the form of "handwritten reserves", accompanied by the signature of the customer. The customer will have to confirm this anomaly by sending to the carrier within two (2) working days following the delivery date a registered letter with acknowledgement of receipt exposing his claims. The customer must send a copy of this letter to : ORGANIC PROVENCE S.A.S, 58 La Canebière, 13001 Marseille.
All our shipments are sent by La Poste. This service delivers in 48 hours throughout France and offers you the possibility to pick up the ordered products at your post office near the delivery address in case of absence from the initial delivery place during when the delivery man came. If you are absent on the day of delivery, you will receive a notice in your mailbox, which will allow you to pick your package up at your post office during opening hours, within 15 days. If your parcel is returned to us after this 15-day period, you will be responsible for the shipping costs, regardless of the amount of your order, according to the current rate for your country code.
ORGANIC PROVENCE S.A.S. will not be responsible for delays and losses due to the service of La Poste, but the buyer must notify us of these failures by sending us an e-mail. At our request, the Post Office will initiate an investigation of 21 days in its services. Generally in this period of time, the Post Office finds the lost parcel and sends it to its recipient. If the product is not found within this period, we will send again either the same product or, with your prior agreement, a similar product. The shipping costs would then be at our charge.
We decline any responsibility as for the lengthening of the delivery periods because of the carrier, in particular in the event of loss of the products or strike.
We are committed to providing you with complete satisfaction for all our products. In accordance with the legislation governing mail order sales in force for online sales, you have the possibility of returning any article in its original condition to our address ORGANIC PROVENCE S.A.S, 58 La Canebière, 13001 Marseille within 14 days of the delivery date and being fully reimbursed for the price of the article concerned by bank transfer or cheque.
This right does not apply to products returned damaged, incomplete, without original packaging, or soiled by the customer.
The packaging and forwarding costs to ORGANIC PROVENCE S.A.S are at the buyer's expense. The buyer must ensure that his packaging is strong enough to allow the products to be received in perfect condition at ORGANIC PROVENCE S.A.S
8. Right of withdrawal and time limit
The Customer has a period of 14 clear days from the date of receipt of his order to return at his expense the products ordered for a refund.
The products must imperatively be returned to ORGANIC PROVENCE S.A.S, 58 La Canebière, 13001 Marseille.
In the case of an exercise of the right of withdrawal, ORGANIC PROVENCE SAS will reimburse the Customer for the corresponding amount within a maximum of thirty (30) working days from the receipt of the return. The reimbursement will be made by crediting the amount debited to the Customer's credit card account, or to Paypal if applicable.
9. Payment of invoices
Any customer placing an order will be responsible for its payment even if he/she requests that the order be delivered to another address.
10. Accepted payments
By credit card
Payments are secured by a high-performance universal encryption system. This SSL encryption process guarantees that the credit card number entered is only known by our payment platform Payplug, based in France. ORGANIC PROVENCE S.A.R.L will only accept an order once the relevant bank payment centers have given their approval. In case of refusal by the said centers, the customer will be notified by e-mail that his order will be automatically cancelled.

By bank or postal check
In case of payment by check, the Customer will make out his check to the order of " ORGANIC PROVENCE ". He will specify his order number on the back of the check and he will send this check by mail to the following address

Only checks issued by a French bank are accepted. ORGANIC PROVENCE SAS will send the products at the earliest 5 working days after cashing the check corresponding to the said order, subject to provisions.
11. Applicable law in case of disputes
In all the cases of litigation, ORGANIC PROVENCE S.A.S commits itself to make every effort to bring an amicable solution there.
The present contract is subject to French law. In case of dispute, the commercial court of Marseille is the only competent court. The company ORGANIC PROVENCE S.A.S cannot be held for person in charge of the damage of any nature, as well material as immaterial or body, which could result from a bad operation or the bad use of the marketed products.
The responsibility of the company ORGANIC PROVENCE S.A.S. will be, in any case, limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products. In all cases, the company ORGANIC PROVENCE S.A.S. cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of reception, its liability is systematically limited to the value of the product in question, value at the date of sale, and this without any possibility of recourse to the brand producing the product.
12. Personal data
ORGANIC PROVENCE S.A.S informs its customers that their personal information is stored for the sole purpose of processing their order. ORGANIC PROVENCE S.A.S will not divulge any confidential information provided by buyers and visitors to its site.
This section shall not prevent the assignment or transfer of business to a third party.
In accordance with the law on data processing and freedom of January 6, 1978, the buyer has a right of access, rectification and opposition to personal data concerning him.
To do so, simply make a request thanks to this form or by mail, indicating your e-mail address, name, first name and address.
The company ORGANIC PROVENCE S.A.S reserves the right to store cookies in the computer of visitors to its website. A cookie does not allow us to identify you. It is a computer file, stored on the hard disk of the user's computer. Its purpose is to indicate a previous visit of the user on the site. Cookies are only used by the company ORGANIC PROVENCE S.A.S in order to personalize the service offered to the user.
14. Intellectual Property
All the elements of the site pulpedevie.com are the intellectual and exclusive property of the company ORGANIC PROVENCE S.A.S. No one is authorized to reproduce, exploit, rebroadcast, or use in any capacity whatsoever, even partially, the elements of the site whether they are software, visual or sound.
